Summary


I have specialised in personal injury and clinical negligence work for the best part of 20 years, during which time I have endeavoured to ensure that my clients receive as much compensation as possible as speedily as possible commensurate with the principles of fairness and justice.


Expertise


I am proud to be a founder member of the Association of Personal Injury Lawyers (APIL) formed 20 years ago, the Premier Organisation for providing assistance to those who are injured as a result of accidents. I am also a member of the Law Society’s Personal Injury Panel and as a firm Pictons are members of the Headway panel which is the National Organisation which supports those with acquired brain injury and their families. Pictons is also a supporter of the Road Victims’ Trust (RVT). I have considerable experience of the financial aspects of running a Legal Practice, an essential asset in the current environment.


Case Studies


I have acted on behalf of a number of claimants in very high value claims where damages in excess of £1million have been recovered. Such awards in cases where the clients’ lives have been shattered by catastrophic injuries provide the clients and their families with some financial security and the ability once again to gain some enjoyment and satisfaction from life despite their disabilities. The recovery of substantial damages in such cases is extremely rewarding and fulfilling. I have extensive experience of more general personal injury claims including those following accidents at work, slips and trips, road traffic accidents and accidents in public places. I also have extensive experience of dealing with lower value clinical negligence claims.

I have over the course of the last three years been very active in campaigning with the Bennett family who are endeavouring to secure a change in law whereby cyclists who unlawfully kill or injure pedestrians can be sentenced by the courts with the same severity as other users of the road. A change in the law has been proposed by the Bennett's MP through the introduction of a ten minute rule bill in March 2011 and a draft bill has been submitted to the Department of Transport for their comments.

Personal


I have always been a keen Cricketer but “wear and tear” on my body over a period of 30 years or so has meant that I have had to hang up my boots and partake of the gentler game of Golf on a regular basis. Family and friends take up the rest of my limited spare time.

I graduated from Cambridge University in Law in 1992 and qualified as Solicitor in 1995. I joined Pictons Solicitors LLP in July 2010 as the Clinical Negligence Team Leader having previously held the position of Head of Clinical Negligence at Coffin Mew LLP from May 2003.

I practice exclusively in clinical negligence and I act on behalf of the injured party only. I deal with cases of all types and value. My experience in clinical negligence has involved me in many areas including spinal injuries, brain injury, obstetric and birth injuries, delayed diagnosis of cancer, fatalities, gyneacology and pressure sores. Recent settlements include £1,250,000 for visual loss arising from a delayed diagnosis of a benign brain tumour (craniopharyngioma) and £950,000 for a spinal cord injury caused by a delayed diagnosis of a benign spinal tumour (ependymoma).

I am a member of the Law Society Clinical Negligence Panel and Senior Litigator Member of the Association of Personal Injury Lawyers. I have been recognised by Chambers UK as a leading individual in clinical negligence.


Case studies

I have achieved many settlements on behalf of Claimants and examples of cases I have settled include:

- £535,000 for a spinal cord injury arising out of a delayed diagnosis of tuberculosis of the spine.

- £400,000 for a claim involving alleged negligence by a hospital in treatment of injuries following a horse-riding accident which left the Claimant with an extended spinal cord injury.

- £40,000 in relation to a claim against an osteopath who carried out manipulation on the Claimant’s spine causing an extension of a prolapsed disc.

- £92,000 for a case involving a delayed diagnosis of breast cancer. I have also settled claims relating to Hodgkin’s Lymphoma, cervical cancer and bowel cancer.

- £225,000 plus an indemnity against possible future recovery of nursing home fees by the local authority amounting to £154,943.14 in a case involving a brain injury arising from a delay in carrying out surgery for an acute subdural hematoma.

- £261,000 for a delayed diagnosis of a slipped epiphysis.

- £275,000 for a failure to adequately treat a scaphoid fracture.

- £170,000 was achieved in relation to a fatal accidents claim on behalf of a widow and her two children involving the incorrect dose of Heparin which lead to the deceased’s death.

- £50,000 for a fatal accidents claim involving an alleged failure by a GP to refer the deceased to hospital when he was suffering symptoms of heart failure. The deceased later passed away from a cardiac arrest.

- £100,000 for a claim involving a delay in prescribing antibiotics for an infection which left the Claimant with facial disfigurement and scarring.

- £50,000 for a Claimant who suffered peritonitis following a perforated stomach that occurred during explorative laparoscopic surgery.

Summary


I qualified as a Solicitor in 2003 and joined Pictons in May 2009. I am a specialist solicitor with a broad range of experience in clinical negligence claims. Before training as a lawyer, I practised as a nurse and midwife and have invaluable insight into the workings of the health service.

As negligence claims are usually complex and of a sensitive nature, I strive to help my client through the whole process and resolve the claim in a prompt and sympathetic manner.

I have a specialist interest in fatal accidents, birth injury, gynaecological and obstetrics injuries and injuries caused by delay in diagnosing cancer. Case Studies


In the past 12 months, I have achieved over half a million pound of damages for claimants and their family. My settled cases include:

£106,000 damages in a perineal trauma case concerning the failure to detect and repair the 3rd degree tear after childbirth.

£100,000 compensation for a fatal accident claim. The deceased’s femoral artery was perforated at an angioplasty but the massive bleeding and deterioration of his condition were not detected. He died of a heart attack.

£68,000 for a disabled pensioner who fell from hospital bed and injured her shoulder during an epileptic fit. The hospital doctor forgot to put the cot side up after taking blood from her.

£83,000 and £38,000 for 2 claimants who had negligent foot surgery carried out by a team of foreign doctors.

£27,000 for a woman whose vagina was sutured too tightly following a vaginal repair operation.

£18,000 for a woman who was wrongly diagnosed as having invasive breast cancer. She underwent a local excision and a number of investigations only to be told that she did not have cancer months later.

£5,000 for a little boy who sustained a fracture in the leg during childbirth and a similar sum for another child for a delay in treating talipes.

Personal


I enjoy sports and travelling. My favourite places are the Lake District, the Mediterranean and Norway. The latter was bitterly cold when I last visited but the breathtaking scenery and its tranquillity are sufficient to compensate for the cold temperature.

Having obtained my law degree at the University of Kent, and completing my LPC at The College of Law, I commenced my training contract with Pictons in May 2010. I worked in the Conveyancing, Family and Clinical Negligence departments before qualifying into the Clinical Negligence team.
