  • Purpose of a Will – to choose who is to inherit your assets
     
  • To appoint people to look after your family and financial affairs when you die
     
  • To define who is to receive your estate. Many married people think that if they die intestate i.e. without having made a Will, then their husband or wife will automatically inherit everything. This is not always the case and a widow or widower could find that their children or even other members of the family could have a claim against the estate
     
  • It is important, if you have children under the age of 18, that you appoint Guardians to look after them in the event of your death
     
  • If you already have a Will then divorce (Decree Absolute) can change the terms of that Will to remove all mention of your ex-spouse, but unless the Will is properly drawn, can cancel your Will altogether. Marriage or re-marriage will revoke your Will unless it is made in contemplation of that particular marriage. Divorce, cohabiting and re-marriage and the related arrangements regarding children may affect appointment of Guardians.
     
  • Advance planning to minimise any Inheritance tax liability
     
  • If you do not make a Will the law decides who inherits your estate and it may not be the people you wanted to benefit.
